The Conditions for posting a vacancy

CareersInEindhoven is part of Employ-IT.
The general terms and conditions of Employ-IT apply to all offers and agreements of the Employ-IT websites. Any deviations from these general terms and conditions are only valid if they have been explicitly agreed in writing.

Responsibility

The content of the Employ-IT websites is compiled with great care and is continuously maintained. Nevertheless, it is possible that the information on our website is incorrect or incomplete. Employ-IT reserves the right to make additions and changes with immediate effect and without notice. Employ-IT is under no circumstances responsible for direct or indirect damage caused by the use of or resulting from the use of Employ-IT or the links mentioned on the website. We are also not responsible for damage caused by not being able to reach our website

Ads & Assignment
Employ-IT is at all times entitled not to place, adapt or post advertisements at its own discretion without this leading in any way to compensation obligations. Advertisements must meet the requirements of de Nederlandse Reclamecode (the Dutch Advertising Code).

Employ-IT makes every effort to execute the Assignment to the best of its ability and to reach and recruit candidates who meet the requirements and expectations of the Client as much as possible, based on the state of the art of information technology at that time, healthcare, engineering, science, and technology.

The obligations of Employ-IT on the basis of the Agreement are in the nature of an effort only by placing a vacancy on one of the websites that Employ-IT manages and is only an obligation of best efforts.

Employ-IT is entitled to have the Agreement executed in whole or in part by third parties, or at least to engage third parties in the execution of the Agreement. Employ-IT will keep secret everything that comes to its knowledge in the exercise of its profession and that is of a confidential nature.

The client agrees that every candidate has equal opportunities regardless of age, sex, marital status, life or religion, political choice, race, ethnic origin or nationality, all this without prejudice to the objective and real job requirements and provided that the candidate is responsible meets the job description in the vacancy described by the client.

The client agrees that the candidate will receive sufficient and correct information about the vacancy and the application procedure, Employ-IT is dependent on the information obtained from the client that applies to this. The Client is responsible for providing the correct information.

The Client is responsible for his ultimate choice of a candidate nominated by Employ-IT. Before entering into an Employment Agreement with the candidate, the Client is obliged to independently form an opinion about the suitability of the candidate.

Employ-IT is in no way liable for damage (direct and indirect and in any form whatsoever) and losses that the Client or third parties may suffer in the context of the performance of the assignment by Employ-IT.

Employ-IT, therefore, does not accept any liability if the candidate does not meet expectations, or if the Client has entered into an Employment Agreement with the candidate on the basis of incorrect or incomplete information.

Employ-IT is in no way liable for damage (direct and indirect and in any form whatsoever) and losses that the Client or third parties may suffer due to negligent or incorrect actions of a candidate during the selection procedure or after entering into an Employment Agreement with the concerning candidate.

Client indemnifies Employ-IT against all claims from third parties that are or could be related directly, indirectly or indirectly to the mediation of Employ-IT.

An Assignment at the moment that the Client receives the proposed candidate from the expiry of the maximum duration of the Assignment agreed between the Parties or through withdrawal of the Assignment by the Client or Employ-IT.

The earlier termination of the Assignment by the Client does not affect the previously agreed price of the assignment and Employ-IT is promised that amount and is entitled to keep the amount. If Employ-IT does not carry out the Assignment, no Assignment takes place, Employ-IT will reverse the amount.

If the Assignment is not carried out, Employ-IT will communicate this in writing to the Client by means of the contact details provided to Employ-IT. Employ-IT is in no way liable for damage (direct and indirect and in whatever form) and losses that the Client or third parties may suffer if the Client has not provided the correct contact details.

The word written also refers to electronic communications such as, but not limited to, e-mail and WhatsApp. Electronic communication between the Parties is deemed to have been received on the day of dispatch, unless proven otherwise.

Prices

The Employ-IT websites are entitled to change the agreed rates and / or prices. All prices are in Euros, excluding VAT and other levies imposed by the government, unless explicitly stated otherwise. All prices displayed by Employ-IT in writing or electronically are subject to programming and typing errors, clerical errors, and mistakes. Employ-IT is not bound by such errors and / or typos.

Subscriptions
All subscribed subscriptions are NOT automatically renewed.
The validity of a quotation is 21 days, unless otherwise agreed.

Payment
Purchases made online must be paid via Paypal or iDeal.
Payment of invoices within 14 days of the invoice date, unless stated otherwise. In case of non-payment or late payment, the rights granted to Employ-IT are immediately withdrawn. All costs incurred, both direct and indirect, including legal costs, are for the account of the client.

Privacy and confidentiality
The personal data from the CV are stored in the Employ-IT database. These data are used to:

  1. Have employers search for the right candidates for their vacancies. Anonymous if desired.
  2. Select the right vacancies that match the candidate’s needs.

Your data will not be used for purposes other than those indicated under the above points without your consent.

Employ-IT processes the Personal Data provided by the Client in the context of the Assignment in accordance with the obligations resting on Employ-IT arising from the General Data Protection Regulation.
